What you need to know

 

Tourist establishments are governed by provincial and municipal legislation. The provincial legislation establishes the definition of various tourist establishments and requires a mandatory registration number from the Corporation de l'industrie touristique du Québec.

The Municipality, for its part, has the authority to decide with its zoning by-law where tourist establishments in principal residences are allowed on its territory. This was the topic of the public consultation held on February 15.

Proposed Regulations 

Here are the main provisions that are proposed in Chelsea to regulate short-term tourist establishments in principal residences. We invite you to read them in order to give your opinion on the subject.

  • A short-term tourist establishment inside a principal residence is permitted in all zones
  • As of January 1st, 2024, only five certificates per year per district will be issued.

 

The Chelsea Park Residents' Association has asked the Municipality to prohibit this type of establishment in their neighborhood. Thus, after analysis, the Municipal Council decided that:

  • A short-term tourist establishment inside a principal residence is prohibited in the two zones that cover the Chelsea Park neighborhood.

 

 

  • A short-term tourist establishment inside a principal residence is permitted in all zones;
  • Only two certificates for principal residence establishments or tourist residences will be approved per zone on a first-come, first-served basis.

*Tourist residences are only allowed in certain zones of the Centre-Village.

 

 

How do I submit a comment?  

 

If you wish to submit a comment on these regulatory provisions and the proposed conditions, we invite you to submit your opinion by email to urbanisme@chelsea.ca no later than March 3rd, 2023.

Comments will be submitted to Municipal Council for their consideration prior to the adoption of the final version of the by-law.

 

Register to be held

 

Once Council has adopted the final version of the By-law, a register will be held as required by provincial legislation. It is scheduled for March 29st, 2023, at the municipal Town Hall located at 100 Chemin d’Old Chelsea.

  • If you support the regulatory provisions and conditions that will be proposed in the final version of the by-law, do not sign the register. No action on your part is necessary.
  • If you oppose some of the regulatory provisions or conditions proposed in the final version of the by-law, we invite you sign the register.

 

The number of signatures collected per zone in the register will determine whether a referendum will be held in the zone where you live.  

 

Referendum

For the purpose of determining whether a referendum must be held in respect to this By-law, the minimum number of signatures needed in the register under the Act respecting elections and referendums in municipalities is reduced by 50%, rounded up to the next whole number. Thus, the exact number of signatures required to justify a referendum in your zone depends on the number of qualified voters living in your zone.
