Adoption of the right of preemption by-law
Council adopted the by-law on the right of preemption. This by-law allows the Municipality to acquire immovables at a fair price for any project for the benefit of the community when they are for sale. This measure therefore allows the Municipality to acquire a property as a priority when an owner wishes to sell it.
Owners of previously identified properties will be individually notified that their property is subject to the right of preemption. Council wishes to reassure residents that this has nothing to do with the power of expropriation. It is a measure allowing the Municipality to be given priority when a resident wishes to sell his property.
It should be remembered that the Municipality had to adopt this by-law following the adoption of the Loi no 37 modifiant diverses dispositions législatives principalement en matière d'habitation. This law was sanctioned on June 10, 2022 by the Government of Quebec.
Adoption of the effective date of the docks and municipal right-of-way occupancy by-law
In order to modify the effective date of the by-law relating to docks and conditions of occupancy of the municipal right-of-way, the Council had to adopt the by-law by modifying the effective date to April 15 instead of January 1, 2023. It should be noted that the original by-law was adopted by the previous Council with an effective date of January 1, 2022, and that the current Council had already amended the effective date to January 1, 2023, to allow them to thoroughly review the by-law.
The council wishes to make a progressive application of the new regulation. It intends to have an implementation plan divided into annual phases until 2027 to allow residents to comply with the new by-law. For more information, visit our website at chelsea.ca/docks.
Contract awarded to develop a strategic plan
In order to define the priorities, challenges and issues, and to orient its actions in the short, medium and long term, the Municipality has initiated the process of developing a strategic plan and an operational plan. Following a call for tenders by invitation, the municipal council awarded the contract to the firm KharmaDarma.
NCC File
In the case of the federal court action against the NCC, Council approved a mandate to DHC Lawyers to pursue legal action against the NCC. The lawsuit follows the NCC's refusal to comply with the advice of the Comité consultatif sur le règlement des différends associés aux paiements en remplacement d’impôts.
Adoption of Demolition Application and Building Occupancy and Maintenance By-laws
Council was concerned with demolition applications throughout the territory and passed the Demolition Application By-law. This by-law was adopted in accordance with the proposed Loi modifiant la Loi sur le patrimoine culturel et d'autres dispositions législatives. It will allow for a better supervision of the approval of demolition and add criteria for the analysis of demolition requests.
In addition, Council also adopted By-law 1243-22 on the occupancy and maintenance of buildings. This by-law is also being adopted as part of the proposed Loi modifiant la Loi sur le patrimoine culturel et d'autres dispositions législatives. It will clarify an owner's responsibilities for the maintenance of heritage buildings and allow the Municipality to acquire a heritage building when a notice of deterioration has been registered in the land register for at least 60 days.
Requests to the Ministère des Transports et de la mobilité durable
Council has made a request to the Ministère des Transports et de la mobilité durable to review the programming of the traffic lights at the Highway 5 exit at the Route 105 intersection. This request is necessary because the green light is regularly given to the secondary lane, the ramp, even though there are no cars on it.
Request to the MRC des Collines-de-l'Outaouais for the installation of a multi-sport center
Council unanimously approved a request to the MRC des Collines-de-l'Outaouais to revise its revised Schéma d'aménagement et de développement (SAD) in order to allow the construction of a multisport center on its territory. The project could take place at 47 Route 105, near the Alonzo Bridge. This multi-sport center would allow mainly the practice of soccer, but also several other sports.
